ANTICIPATED  LIVING WILL

Getting Started

The declaration of an anticipated vital will  is the right that a person has to decide on the medical or clinical actions that may be taken on their behalf in the future; assuming that when the time arrives, the person lacks the capacity to decide for itself.

The right to perform a written declaration of an anticipated vital will can be exercised by any adult or emancipated minor, who is in a position to decide in relation to their convictions and preferences.  This act has to be signed in the presence of a Notary.

The Andalusia Health Service has created “The Register of Anticipated Vital Wills",

This register keeps and records all declarations made in Andalusia.


Procedure for making the statement

You need a special set of forms available in FRAB,  at the Offices of Health and at all public health centres in Andalusia.

The process is very simple: you just have to make an appointment with us. We will prepare the text in a bilingual document. Once you are happy with the content we will accompany you to sign it at the Notary’s Office.

To formalize the registration, this document will have to handed in personally at the registrar at the Provincial Delegation of Health.  DelegaciĆ³n Provincial de Salud”.

Observations

At the present time, the Anticipated Vital Will,  can only be executed within the Autonomous Region of Andalusia, however is expected to be extended to all the Autonomous Communities once set in motion the National Register.

The declaration may be amended or revoked at any time, following the same procedure followed on the registration.

The Registry of Anticipated Vital Will can only be consulted by the doctor treating you and only if you can not express your desires by yourself.
